This End User Licence Agreement (EULA) describes Connect Plus and the Terms and Conditions of Use. Please read this document and Terms and Conditions carefully.
The EULA and terms and conditions create a contract between you and Quality Practice Accreditation Pty Ltd. In purchasing a licence pack, you acknowledge that you have read and understand this EULA and agree to the terms and conditions.
ABOUT CONNECT PLUS
Connect plus is an on-line audit and assessment tool and simplified quality management system for medical practices developed by Quality Practice Accreditation Pty Ltd (QPA).
The assessment tool is an enhanced version of the survey visit assessment document that is used by surveyors assessing practices for accreditation against standards established by the Royal Australian College of General Practitioners (RACGP).
The RACGP is accepted as the arbiter of standards in Australian general practice and the standards provide a benchmark for quality in general practice and also have wider applicability for other health services.
The standards are copyright and QPA has a licence with the RACGP to use the standards.
WHAT CONNECT PLUS DOES
Connect plus is designed to:
- provide a quality improvement framework and process to support general practices in preparing for accreditation,
- build a depth of understanding the standards and how these relate to quality,
- engage all doctors, nurses and practice support staff in a quality improvement process, and
- support audit and quality improvement in all health services.
Connect Plus can be used by:
- general practices as a comprehensive audit and self-assessment against the standards in preparing for accreditation, or
- any office based general or specialist medical practice or primary health care practice as a quality audit tool, or
- providers of support services to general practice such as practice management consultants or accreditation support personnel from Primary Health Networks (PHNs).
An organisational User can purchase one or more single use licence packs. They can then give secure access, based on the number of licenses purchased, to doctors, nurses, other clinicians and support staff to the Connect Plus individual on-line questionnaire based audit assessment tool.
The assessment tool can be completed and an individual report generated. Results can be compared across multiple individual users and multiple health services or practices. A timeframe is set for completion of the assessment tool.
Individual users are encouraged to complete all applicable questions and provide comments that will support analysis of results and quality improvement.
Connect plus provides a management and administration interface and supports multiple users and multiple practices or health services. It provides comparative reports across users and practices that can aide education and training of and enhanced feedback from doctors, nurses and support staff.
The assessment tool collects information about the standards from a number of areas and perspectives. These include:
- direct observation of premises and facilities,
- review of practice documentation including policy and procedures manuals
- review of clinical systems
- audits of medical equipment and doctors bag
- medical records review and
- interview with doctors, nurses, other clinicians and support staff.
As such information about the standards can be audited and assessed from different perspectives and triangulated, building a better picture of how a practice or health service provides quality care.
Practices or health services are free to use Connect Plus as they choose, subject to the terms and condition of use. While areas of the assessment tool can be marked as not applicable, QPA recommends that all individuals completing the document do so as an auditor might to build a greater depth of understanding of the standards and provide different insights into areas of the practice.
QPA does not warrant or guarantee that practices, in using the assessment tool, will achieve accreditation or that accreditation will necessarily be simpler, easier or cheaper.
STANDARDS COMPLIANCE
Connect Plus is compliant with, and covers all standards, criteria and indicators in the current edition of the RACGP Standards for general practices. Organisations, practice groups
USE OF CONNECT PLUS
To use Connect Plus you require compatible hardware, up to date software including a web browser (Google Chrome or Apple Safari recommended) and a reliable, fast internet connection. These factors may influence the use, responsiveness, data integrity and reliability of Connect Plus.
FEES CHARGES AND TAXES
QPA will charge you a single use licence fee for the number of licences you purchase.
The fees charged and licensing packs are available and advertised on the Connect Plus website and are confirmed prior to purchasing Connect Plus.
Licence fees will include Australian Goods and Services Tax (GST).
Except as required by law no refunds will be provided once a purchase has been confirmed and the assessment tool within Connect Plus has been accessed.
PRIVACY POLICY
Use of your personal information is governed by the QPA Privacy Policy available at: www.gpa.net.au
LICENSING
Practices, health care organisations and individuals can purchase licensing packs that specify the number of assessment tools available for individual users.
QPA provides each user with a limited licence to use and complete one Connect Plus assessment tool.
Users must complete and submit the tool within the timeframe specified on the Connect Plus website.
The time remaining to expiry of the licence is also shown on the assessment tool.
The individual who purchases a licence pack on behalf of themselves or a health care organisation or general practice can assign other users up to the number of licences purchased.
Purchasing a licence pack or multiple licence packs does not grant a purchaser any ownership rights or rights to transfer the licence to another party
On submission of the assessment tool an individual report will be provided and accessible on-line
USER ID
Using Connect Plus and accessing the assessment tool requires a unique User ID.
Your User ID enables you to access your assessment tool and any reports generated for the duration of your licence.
Your User ID is valuable, and you are responsible for maintaining its confidentiality and security. QPA is not responsible for any losses arising from the unauthorised use of your User ID.
Please contact QPA if you suspect that your User ID has been compromised.
INTELLECTUAL PROPERTY
The Connect Plus logo, assessment and audit tool and all information provided is copyright.
Each individual user is permitted to access and complete one assessment tool only.
Users must not provide their user log in details to any other person.
Users must not copy or reproduce the assessment document but may download and print multiple copies of their individual report.
QPA reserves the right to change Connect Plus, including fees and charges and this EULA and Terms and Conditions at any time.
WARRANTY
You expressly acknowledge and agree that use of Connect Plus is at your sole risk. To the extent permitted by applicable law, Connect Plus is provided as is and as available, with any faults and without warranty of any kind.
QPA denies any warranties in regard to the use of Connect Plus.
No verbal or written information or advice provided by QPA or its authorised representatives shall create a warranty or guarantee that practices, in using the assessment tool in preparing for accreditation, will achieve accreditation or that accreditation will necessarily be simpler, easier or cheaper.
You assume the entire cost of any changes to quality systems or infrastructure made as a result of completing Connect Plus.
LIMITATION OF LIABILITY
To the extent permitted by law, QPA shall not be liable for damages including without limitation personal injury, third party liability, loss of profits, loss of data, business interruption or other commercial damages or losses arising out of, or related to the use of Connect Plus. In no event shall QPA’s total liability to you for all damages (other than as may be required by
applicable law in cases involving personal injury) exceed the cost of the licences purchased.
You agree that you will not use Connect Plus for any purposes prohibited by the laws of any country in which you are using Connect Plus.
APPLICABLE LAW
Except to the extent expressly provided in the following paragraph, this EULA and the relationship between you and QPA shall be governed by the laws of the State of New South Wales in Australia.
You and QPA agree to submit to the personal and exclusive jurisdiction of the courts located within the state of New South Wales.
QPA shall use reasonable efforts to protect information submitted by you in connection with Connect Plus but you agree that submission of your information is at your sole risk, and you hereby release QPA from any liability to you for any loss relating to the submission of information.
TERMINATION
This Connect Plus EULA is effective until terminated by you or QPA or until the expiry date for submission of each users’ assessment document.
Your rights under this EULA will terminate automatically if you fail to comply with any of its terms.
SERVICES AND CONTENT USAGE RULES
Your use of the Connect Plus must follow the rules set forth in this section (Usage Rules). Any other use of Connect Plus is a material breach of this Agreement. QPA may monitor your use to ensure that you are following these Usage Rules.
You may use Connect Plus only for personal, non-commercial purposes (except as provided for in this EULA).
QPA’s delivery of Connect Plus does not transfer any promotional use rights to you, and does not constitute a grant or waiver of any rights of any other copyright owners.
It is your responsibility not to lose, destroy, or damage any information created by using Connect Plus. You may not tamper with or circumvent any security technology included with Connect Plus.
FEEDBACK AND QUESTIONS
QPA encourages you to provide feedback on the quality and use of Connect Plus to support us in developing and improving quality assessment tools for medical practices and health services.
Feedback must comply with the Submissions Guidelines below, which may be updated from time to time.
In providing feedback or comments you grant QPA a worldwide, royalty-free, perpetual, nonexclusive license to use the feedback or comments you submit in further developing Connect Plus and related marketing.
QPA may monitor and decide to remove or edit any feedback or comments.
SUBMISSION GUIDELINES
You may not use the feedback or contact pages of Connect Plus to:
- post any materials that you do not have permission, right or license to use;
- post objectionable, offensive, unlawful, deceptive or harmful content;
- post personal, private or confidential information belonging to others;
- impersonate or misrepresent your affiliation with another person, general practice, health care service or other organisation;
- post or transmit spam, including but not limited to unsolicited or unauthorised advertising, promotional materials, or informational announcements
- plan or engage in any illegal, fraudulent, or manipulative activity.

CONTRACT CHANGES
QPA reserves the right at any time to modify this EULA and to add new or additional terms or conditions on your use of Connect Plus. Such modifications and additional terms and conditions will be effective immediately and incorporated into this Agreement. Your continued use of Connect Plus will be deemed acceptance of such modifications to the EULA and terms and conditions.
INTELLECTUAL PROPERTY
You agree that Connect Plus, including but not limited to content, graphics, logos, user interface, audio clips, video clips, editorial content, and the scripts and software used to implement Connect Plus, contain proprietary information and material that is owned by QPA and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright.
You agree that you will not use such proprietary information or materials in any way whatsoever except for use of Connect Plus for personal, non-commercial uses in compliance with this EULA.
No portion of Connect Plus may be reproduced in any form or by any means, except as expressly permitted by this EULA.
You agree not to modify, rent, loan, sell, or distribute Connect Plus including the assessment tool in any manner, and you shall not use or exploit Connect Plus in any manner not expressly authorised.
Quality Practice Accreditation, QPA, Connect Plus, the QPA logo, and other QPA trademarks, service marks, graphics, and logos used in connection with Connect Plus are trademarks or registered trademarks.
You are granted no right or license with respect to any of the aforesaid trademarks.
TERMINATION AND SUSPENSION OF SERVICES
If you fail, or QPA suspects that you have failed, to comply with any of the provisions of this EULA, QPA may, without notice to you and without providing any compensation:
- terminate this agreement and/or your User ID
- remove your access to Connect Plus including all on-line assessment tools and reports
QPA further reserves the right to modify, suspend, or discontinue Connect Plus (or any part or content thereof) at any time with or without notice to you, and QPA will not be liable to you or to any third party should it exercise such rights.
OTHER PROVISIONS
This EULA constitutes the entire agreement between you and QPA and governs your use of Connect Plus. It supersedes any prior agreements with respect to the same subject matter between you and QPA.
You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, third-party software, or additional services such as the Volume Purchase Program.
If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
QPA's failure to enforce any right or provisions in this EULA will not constitute a waiver of such or any other provision. QPA will not be responsible for failures to fulfil any obligations due to causes beyond its control.
You agree to comply with all local, state, federal, and national laws, statutes, ordinances, and regulations that apply to your use of Connect Plus. Your use of the Connect Plus may also be subject to other laws.
Risk of loss for all electronically delivered material pass to the user upon electronic transmission.
No QPA employee or agent has the authority to vary this EULA. QPA may notify you with respect to the Services by sending an email message to your email address or a letter via postal mail to your mailing address, or by a posting on the Connect Plus website.
Notices shall become effective immediately. QPA may also contact you by email or push notification to send you additional information about Connect Plus.
You hereby grant QPA the right to take steps QPA believes are reasonably necessary or appropriate to enforce and/or verify compliance with any part of this EULA.
You agree that QPA has the right, without liability to you, to disclose any data and/or information to law enforcement authorities, government officials, and/or a third party, as QPA believes is reasonably necessary or appropriate to enforce and/or verify compliance with any part of this EULA (including but not limited to QPA's right to co-operate with any legal process relating to your use of Connect Plus, and/or a third-party claim that your use of Connect Plus and/or Content is unlawful and/or infringes such third party's rights).
